Please be advised that the Notice of Intent To Construct (NOITC) filing is only the initial step in the livestock management facility approval process. The project status information provided here only represents a project's NOITC filing status, not the final overall project review status. Once a project's NOITC is deemed complete and meets all the applicable requirements of the Livestock Management Facilities Act (Act), it is approved by the Department.

The next step in the review process is the submittal and review of construction plans associated wit the manure handling portions of the proposed facility. If the submitted plans are deemed compliant with the applicable provisions of the Act, they are approved by the Department. The project may also be subject to the Public Informational Meeting and County board Recommendation process, depending on the project's size, expressed in animal units, and whether the project includes the proposed use of an anaerobic lagoon manure storage and treatment system. Projects are also subject to at least three on-site inspections by the Department: at least once prior to construction; at least once during construction; and finally at least once after construction has been completed but before the facility has been placed into service.

Once a facility is deemed compliant with all applicable provisions of the Act, including but not limited to the NOITC filing requirements, construction plan provisions, public informational meeting requirements (if Applicable), various construction-related certifications, and any specific manure management planning requirements, the overall project is approved and the facility can be placed into service.
